Still Working Always Working, LLC

These Terms & Conditions ("Terms") are an agreement between you and Still Working Always Working, LLC ("SWAW," "we," "us"). By using our website, buying our products, using our services, or communicating with us by phone, text, or email, you agree to these Terms and to our Privacy Policy.
1. What We Offer
- Books, including the SWAW Reset Series, sold through Amazon.
- Digital products and the 12-Week Custom Plan, sold through Gumroad.
- Coaching and fitness content.
- Services for local businesses, including website builds, Google Business listing setup and cleanup, call tracking, and related setup work.
Purchases made on Amazon, Gumroad, or any other platform are also covered by that platform's terms and refund policies.
2. Health and Fitness Disclaimer
Our books, plans, posts, and coaching are for general fitness and education only. They are not medical advice, diagnosis, or treatment. Talk to your doctor before starting any exercise or nutrition program, especially if you have a medical condition, an injury, or take medication. You are responsible for your own health decisions. Stop any exercise that causes pain and get medical help if you need it.
Results vary from person to person. We do not promise or guarantee any specific weight loss, health, or fitness result.
3. Business Services
For website, listing, and call tracking builds, the scope, price, and timeline for your project are set in the written proposal or messages we agree on before work starts. Current standard pricing for a Store Launch build is $997 unless we agree otherwise in writing.
Your accounts stay yours. Domains, listings, and platforms we set up for you are registered in your name or your business's name whenever the platform allows it. Monthly care or management plans, where offered, run month to month and can be cancelled as stated in your agreement.
We do not guarantee search rankings, lead volume, call volume, or sales. We report the numbers we can measure and we show our work.
4. Text Messaging (SMS) Terms
By giving us your mobile phone number and consenting as described below, you agree to receive text messages from Still Working Always Working, LLC at that number.
How consent is given. Consent is obtained in one of these ways:
- Inbound call: you call our business phone number, and we may return or follow up on your call by text about your inquiry, including when we miss your call.
- Verbal consent: on a call, we tell you we may text you about your inquiry, that message and data rates may apply, and that you can reply STOP to opt out, and you agree.
- Web form: you submit your phone number through a form and agree to be contacted by text.
Program description. Texts are used for replies and follow-ups about your inquiry, scheduling, plan check-ins, project updates, and, if you signed up for them, offers.
Message frequency varies. It depends on your inquiry and the conversation.
Message and data rates may apply. Your carrier's charges are your responsibility.
Opt out. Reply STOP at any time to stop receiving texts. You may receive one confirmation message after you opt out. Reply HELP for help, or contact us at swaw1003@gmail.com or (845) 422-3145.
First message. Our first text message identifies our business and includes opt-out instructions.
Not a condition of purchase. Consent to receive text messages is not a condition of buying any product or service.
No sharing for marketing. Mobile phone numbers and SMS consent are not shared with third parties or affiliates for their marketing or promotional purposes.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your phone.
Your number. You agree that the number you give us is yours and that you will tell us if it changes or is reassigned.
5. Email
If you join our email list, we may send updates about books, products, and services. Every marketing email includes an unsubscribe link. We may still email you about an order, a plan, or a project you have with us after you unsubscribe from marketing.
6. Intellectual Property
Our books, plans, posts, logos, and the "Still Working. Always Working." brand belong to Still Working Always Working, LLC or its owner. You may not copy, resell, or share our paid products. A purchase gives you a personal license to use the product yourself.
7. Acceptable Use
Do not misuse this website or our services. Do not break the law, infringe anyone's rights, or attempt to disrupt the site or our accounts.
8. Limitation of Liability
To the fullest extent allowed by law, Still Working Always Working, LLC is not liable for indirect, incidental, or consequential damages arising from your use of our website, products, or services. Our total liability for any claim is limited to the amount you paid us for the product or service involved in the claim.
9. Changes to These Terms
We may update these Terms. The new version will be posted on this page with a new effective date. Continuing to use our website or services after an update means you accept the new Terms.
10. Governing Law
These Terms are governed by the laws of the State of New York.
